Data Subject means the identified or identifiable living individual to whom Personal Data relates. For purposes of this Policy, Data Subjects include any individuals defined as Data Subjects (or their reasonable equivalents) under all Applicable Law, including:

Oyster Academy Users: Individuals that participate in online training through Oyster Academy.

Oyster Candidates: Individuals that apply for a position as Oyster Staff.

Oyster Connect Community Members: Individuals – typically former Oyster Staff – that engage with the Oyster Connect Slack Community.

Oyster Contractors: Third parties engaged to provide services to Oyster Customers on a contractor basis and whose contract and payment are managed through the contractor services on the Oyster Platform.

Oyster Customer Administrators and Authorized Users: Individuals accessing the Oyster Platform on behalf of an Oyster Customer for the purpose of administering the Oyster Customer account and binding the Oyster Customer to the actions taken in the Platform.

Oyster Employer-of-Record (EOR) Team Members: Oyster employees (or employees of an Oyster Third-Party EOR) who provide services to Oyster Customers through the Oyster Platform.

Oyster Intelligence Data Subjects: EOR Team Members, Oyster Payroll Team Members, and other employees of Oyster Customers whose data may be shared with Oyster by Oyster Customers for analysis and benchmarking purposes under the Oyster Intelligence Services.

Oyster Payroll Team Members: Employees of Oyster Customers to whom payments are made, or directed to be made, by the Oyster Customer through the Oyster Platform.

Oyster Prospects: Individuals that Oyster has identified as potential Customers.

Oyster Staff: Employees or Independent Contractors engaged by Oyster HR, Inc., a Third-Party EOR, or an Oyster subsidiary for the purpose of providing services to Oyster HR, Inc.

Oyster Team Members: Individuals engaged by Oyster Customers through the Oyster Platform, including EOR Team Members, Payroll Team Members, and Oyster Contractors.

People Builders Community Member: Individuals that have joined Oyster's People Builders Community, to meet, exchange ideas, and learn from one another during virtual workshops and collective brainstorming sessions.

Website Visitors: Individuals that visit any Oyster Website, including oysterhr.com and all of its subdomains.

Oyster means Oyster HR, Inc., a Delaware public benefit corporation.

Oyster Customer means an entity or individual that contracts with Oyster for the provision of services by or through Oyster.

Oyster Intelligence Services means services provided through the Oyster Platform as further set forth in the Oyster Intelligence Services Terms of Use, available at https://app.oysterhr.com/legal-notices/intelligence_services_terms.

Oyster Platform means the Software as a Service platform available at https://app.oysterhr.com.

Third-Party EOR means a local employer of record (other than an Oyster Subsidiary) through which Oyster EOR Team Members or Oyster Staff Members may be employed.

Personal Data (or Personal Information) means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

Data Subjects may also lodge a complaint with their country’s proper oversight agency. We would, however, appreciate the chance to deal with any concerns directly before such a complaint is filed.
